By requesting and/or receiving services through the BeWell Immediate HealthCare (“BeWell”) website, you agree to be bound by the terms of service set out below (the “Agreement”). If you do not agree to all of the terms of this Agreement, do not use our Services. BeWell may revise and update this Agreement at any time. Your continued use of our Services will mean you accept the revised Agreements. We may modify this Agreement from time to time. All changes will be posted, and the effective date will be noted at the top of this Agreement. Therefore, you should review it periodically so that you are up to date on our most current Terms of Service.
Scope of Services
The aim of BeWell is to provide evaluation of and treatment for common and minor illnesses via telehealth. DO NOT USE BEWELL’S SERVICES TO SEEK HEALTH CARE SERVICES FOR SOMEONE WHO IS UNCONSCIOUS, NOT BREATHING OR GASPING FOR AIR, EXPERIENCING AN ALLERGIC REACTION, HAVING CHEST PAIN, UNCONTROLLABLY BLEEDING, EXPERIENCING A BEHAVIORAL HEALTH EMERGENCY, OR ANY OTHER SYMPTOMS THAT REQUIRE IMMEDIATE OR EMERGENT MEDICAL ATTENTION. CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM (ER) IMMEDIATELY IF YOU HAVE AN EMERGENCY MEDICAL NEED.
You acknowledge that, if you are experiencing any of the symptoms listed above, you will not attempt to use the Services and will immediately seek emergency medical attention.
In some cases, to adequately address your medical condition, you may require additional evaluation in the form of laboratory tests or diagnostic imaging studies (X-rays, CT scan, etc.). You may also require additional encounters with a healthcare provider to reassess your medical condition, follow-up on the results of relevant laboratory or imaging studies or provide ongoing specialty care.
You understand that, while BeWell will make a reasonable attempt to refer you to local laboratories, diagnostic imaging centers and specialty providers, it does not have the ability to order or perform such studies or to provide specialty medical expertise. Further you acknowledge that, if recommended by BeWell, obtaining additional care will be solely your responsibility.
Eligibility
You must be 18 years of age or older to schedule a visit with an BeWell provider. Parents or guardians of minors may schedule a visit for their minor child. By using the Services you represent that you are at least 18 years of age.
Payment obligation
BeWell accepts credit card payment for Services. Relevant fees for Services are posted on our website (https://bewellic.com/pricing/) and are subject to change. BeWell does not contract with commercial insurance or workmen’s compensation plans. During the registration process your credit card information will be collected and the full amount will be charged to this card at the time the visit is scheduled. If for any reason you must cancel your appointment, the full amount will be refunded provided the cancellation occurs more than two hours before your appointment time. By accepting the terms of the Agreement you agree to provide valid credit card information when scheduling your visit and to provide payment in full at the time your visit is scheduled.
Indemnification
You agree to defend, indemnify, and to hold harmless BeWell, together with its officers and directors, from any and all liabilities, penalties, claims, causes of action, and demands brought by third-parties (including the costs, expenses and attorneys’ fees on account thereof) arising, resulting from or relating to: (a) your use of or inability to use the Services, (b) an allegation that you violated any representation, warranty, covenant or condition in this Agreement; (c) your intentional or negligent misrepresentation or misuse of confidential or protected information. Your agreement to defend, to indemnify, and to hold BeWell (and its officers and directors) harmless applies whether any claim against BeWell is based in allegations of violation(s) of law or contract or tort (including strict liability), and regardless of the form of action, including but not limited to your violation of any third-party rights, a claim that the Services and/or our website caused damage to you or to any third party and/or your use and access to the Services. This indemnification section shall survive your termination of or cessation of use of the Services.
Limitation of Liability
BeWell’s maximum liability for any action arising under this Agreement, regardless of the form of action and whether in tort, contract, indemnification, or any other theory, shall be limited to the amount of fees paid by Patient under this Agreement pursuant to which the claim is brought. In no event shall BeWell be liable for indirect, special, incidental, punitive, or consequential damages of any kind, including without limitation, for lost profits however arising and on any theory of liability, even if BeWell has been advised of the possibility of such damages, nor shall BeWell be liable for the cost of procurement of any substitute services. This limitation of liability represents the agreed to and bargained for understanding of the Parties.
